Privacy and cookie policy

This page explains what personal data I process through chertes.legal, for what purpose, on what legal basis, and what rights you have. It is written to be read, not to be ticked off a list.

Who the controller is

Cabinet de avocat Dan-Sebastian Chertes, member of the Cluj Bar, with professional offices at str. Andrei Șaguna nr. 34-36, ap. 29, Cluj-Napoca, Cluj county, Romania.

I have not appointed a data protection officer, as the activity of the practice does not fall within the situations where the law requires one. For anything concerning your data, contact me directly at the details above.

Professional privilege

As a lawyer I am bound by professional secrecy in relation to any matter connected with a client’s case, under Romanian Law no. 51/1995 and the Statute of the profession. This obligation is stricter than general data protection requirements and applies whether or not a legal services agreement has been signed.

A practical warning: the contact form and ordinary email are not secure channels. Write only as much as I need in order to understand what kind of case this is and to arrange a meeting. The details of your case are best discussed in person, not in writing over unsecured channels.

What data I process, and why

The contact form

When you submit the form on the contact page, I process your name, phone number, email address, the urgency you indicate and the content of your message, so that I can reply and, where appropriate, arrange a consultation.

This data is not stored in the website’s database. It is sent directly by email to the practice and stays in my mailbox.

Direct contact by email or phone

If you write or call me directly, I process the data you choose to give me, in order to respond.

Server logs

The server hosting this site automatically records the IP address, browser type, date and time of access and the page requested. These logs serve only technical operation and security.

Protection against unauthorised access

The site’s administration area is protected against automated login attempts. For this purpose the IP address of whoever attempts to log in is processed. This does not concern ordinary visitors.

Legal basis

  • Steps prior to entering into a contract — Article 6(1)(b) of Regulation (EU) 2016/679, for data sent through the form or by email with a view to a consultation.
  • Legitimate interests — Article 6(1)(f), for the security and proper functioning of the site.
  • Legal obligation — Article 6(1)(c), for data I am required by law to keep in connection with legal services agreements.

How long I keep data

  • Messages received through the form or by email that do not lead to instructions: no more than one year.
  • Data relating to a case in which I acted for a client: for the period required by the rules of the profession and by statutory archiving obligations.
  • Server logs: the hosting provider’s retention period, usually a few weeks.

Who the data is disclosed to

I do not sell or rent data. Technical infrastructure is provided by the website hosting provider and the email service provider, who act as processors and are bound by confidentiality obligations.

Data may be disclosed to authorities where the law requires it, within the limits of legal professional privilege.

Transfers outside the European Union

Simply visiting this site does not involve transferring your data to third parties outside the European Union. The fonts used by the site are hosted locally, on the site’s own server, precisely in order to avoid such transfers.

Cookies

This site uses no analytics, tracking or advertising cookies. There is no Google Analytics, no social network pixels, and no profiling of visitors.

The only cookies that may be set are strictly necessary for the technical operation of the site: session and authentication cookies, which appear only for people who log into the administration area, and technical cookies used by the caching system to serve pages faster.

Consent is not required for strictly necessary cookies, which is why this site does not display a cookie banner. You can still block cookies from your browser settings, bearing in mind that some functions of the site may stop working correctly.

Links to other sites

The site contains links to external sources, such as the courts portal, the Cluj Bar website or social media profiles. Once you follow such a link, the privacy policy of that site applies, and I have no control over it.

Your rights

As a data subject you have the right of access, rectification, erasure, restriction of processing, data portability, and the right to object to processing based on legitimate interests. You can exercise them by writing to contact@chertes.legal. I reply within one month at the latest.

These rights are exercised within the limits of legal professional privilege: I cannot erase or disclose information where the rules of the profession require me to keep it.

If you consider that the processing does not comply with the law, you may contact the Romanian National Supervisory Authority for Personal Data Processing (B-dul G-ral. Gheorghe Magheru nr. 28-30, sector 1, Bucharest) or the courts.

I will update this page whenever the way the site works changes. The date of the last update is shown below.
